Why legal authority and technical access are separate

Probate, trusts, powers of attorney, corporate instruments and provider rules determine who may act. A password or recovery phrase is only technical capability; possession does not create ownership or authority.

The exact process, privacy and timing vary by jurisdiction, asset title and service contract. Avoid fixed promises about how long probate takes or whether a particular structure keeps every record private. Ask a qualified adviser how the relevant assets are owned and what documents remain authoritative.

Three complementary planning layers

Legal and ownership layer: identify the executor, trustee, attorney or company decision-maker and the assets each role may control.

Platform layer: configure current provider tools such as Apple Legacy Contact and Google Inactive Account Manager for eligible platform data. These tools have their own verification, exclusions and terms.

Operational layer: maintain an account and asset inventory, provider recovery steps, adviser contacts, separately held factors and a first-day/first-week runbook.

How to keep sensitive details out of long-lived legal documents

A will or trust may be copied, disclosed or retained for many years, while credentials change frequently. Put roles, consent and legally significant directions in the appropriate instrument. Put current system details in a separately controlled and regularly reviewed handover.

The handover can point to authoritative originals and independent key custody without listing every live secret. Minimise the payload and separate recovery factors so one compromise does not expose the entire estate.

A tested access plan

Map each asset to:

• legal owner and authorised role • provider and account identifier • platform legacy or deceased-user process • normal and emergency recovery method • location of independently held factors • person responsible for review • action that must wait for professional advice

Rehearse with harmless accounts and low-value assets. Verify that the intended person can identify the right provider, establish authority and recover a sample without using the owner's everyday device.
